1. Terms of Use

1.1 Acceptance of Terms

By accessing, downloading, or using ViscoelasticsApp ("the App," "our App," "the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the App.

1.2 Description of Service

ViscoelasticsApp is a mobile application that provides educational and academic consultation content related to viscoelastic coagulation testing, including but not limited to ROTEM, TEG, and Quantra platforms. The App offers interactive curve simulation, parameter reference values, clinical decision educational algorithms, and learning resources based on current medical literature with continuous updates.

1.3 Eligibility

The App is intended for use by healthcare professionals, medical students, researchers, and individuals with relevant medical or scientific education. By using the App, you represent that you have the appropriate professional background to understand and contextualize the educational content provided.

1.4 Account Registration

To access certain features, you may be required to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

1.5 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Medical Disclaimer

2.1 Educational Purpose Only

All content provided within ViscoelasticsApp — including parameter interpretations, clinical algorithms, therapeutic suggestions, and reference values — is provided solely for educational and informational purposes. The information is based on published scientific literature and international clinical guidelines and is intended to supplement, not replace, professional medical education and training.

2.2 Not a Medical Device

ViscoelasticsApp has NOT been certified, cleared, or approved by any regulatory body including, but not limited to:

• The U.S. Food and Drug Administration (FDA)
• European Medicines Agency (EMA) or CE marking authorities
• INVIMA (Instituto Nacional de Vigilancia de Medicamentos y Alimentos)
• Any other national or international regulatory body for medical devices

2.3 Professional Medical Judgment

The App does NOT replace:

• Professional medical judgment and clinical expertise
• Institutional protocols and standard operating procedures
• Current clinical practice guidelines
• Patient-specific clinical assessment
• Laboratory confirmation and quality control procedures

2.4 Clinical Responsibility

Any and all clinical decisions — including transfusion decisions, drug administration, surgical interventions, or any other patient management actions — are and remain the sole responsibility of the treating healthcare professional. The developers, owners, and operators of ViscoelasticsApp assume no responsibility whatsoever for any clinical decisions made or patient outcomes resulting from the use of the App.

2.5 No Patient Data

The App is not designed to store, transmit, or process actual patient data for clinical purposes. Any data entered into the App should be treated as educational simulation data only.

3. Privacy Policy Summary

3.1 Data Collection

We collect only the data strictly necessary for the App to function:

• Account data: name, email and encrypted password (or social provider ID: Google/Apple) when you register
• Optional professional profile: medical specialty, institution, country (voluntarily provided)
• Minimal technical data: anonymous device identifier, operating system, language, and crash logs for diagnostics
• Captured images: ROTEM/TEG/Quantra device images are sent to Google Vertex AI for real-time analysis — NOT stored on our servers or on Google's
• Anonymous academic clinical cases: if you choose to save cases, stored without patient identifiers, for collaborative educational purposes

We DO NOT collect: patient identification data, patient medical history, GPS location, contacts, personal photos, biometric data or personal health data of the user.

3.2 Data Security

• All communications encrypted via TLS 1.3
• Passwords stored with bcrypt (non-recoverable)
• Google/Apple authentication via OAuth2 / OpenID Connect
• Database access restricted by roles and audited
• Data minimization and privacy-by-design principles applied

3.3 Data Sharing

We do not sell, rent, or trade your personal information. We share strictly operational data only with: Google Cloud Platform / Vertex AI, Apple Inc. (Sign in with Apple), and Supabase (database and authentication). None of these providers use your data for purposes other than those described.

3.4 Your Rights

Under GDPR and CCPA you may access, correct, delete, export, or restrict processing of your data at any time. You may withdraw consent by deleting your account. Contact: support@viscoelasticsapp.com

4. Subscription & Payment Terms

4.1 Free Tier

ViscoelasticsApp offers a free tier with limited features. The free tier may be modified, expanded, or restricted at our discretion.

4.2 Premium Subscription

Premium features are available through a paid subscription. By subscribing, you agree to:

• Pay the applicable subscription fees as displayed at the time of purchase
• Automatic renewal at the end of each billing period unless cancelled
• Fees are charged exclusively through Apple In-App Purchase (iOS)

4.3 Cancellation & Refunds

You may cancel your subscription at any time through your profile settings within the App or through your Apple ID subscription management in iOS Settings. Upon cancellation, you retain access to Premium features until the end of your current billing period. Refund policies are governed by Apple's App Store terms.

4.4 Institutional Licenses

Institutional (hospital, university, or organizational) licenses are available under separate agreements. Contact: support@viscoelasticsapp.com

4.5 Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price changes take effect.

5. Intellectual Property

5.1 Ownership

All content, features, functionality, design, code, graphics, logos, and trademarks within ViscoelasticsApp are the exclusive property of ViscoelasticsApp / MongiCore and its licensors. This includes but is not limited to:

• The ViscoelasticsApp name, logo, and branding
• Software code and algorithms
• Educational content and clinical decision frameworks
• User interface design and visual elements
• Documentation and instructional materials

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal and professional educational purposes, subject to these Terms.

5.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App content in any commercial product or service without prior written permission
• Remove or alter any proprietary notices or labels
• Use the App in any manner that could damage, disable, or impair the Service

5.4 Third-Party Content

The App references current peer-reviewed medical literature for educational purposes. All such references are attributed to their respective authors and organizations. ViscoelasticsApp is not affiliated with, endorsed by, or sponsored by any organization.

6. Limitation of Liability

6.1 Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

6.2 Limitation

To the maximum extent permitted by applicable law, ViscoelasticsApp, its developers, owners, officers, directors, employees, agents, and affiliates shall NOT be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, goodwill, or other intangible losses
• Any clinical decisions made based on information provided by the App
• Any patient outcomes, adverse events, or medical complications
• Any errors, omissions, or inaccuracies in the content
• Any unauthorized access to or alteration of your data
• Any interruption or cessation of the Service

6.3 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount you have paid to ViscoelasticsApp in the twelve (12) months preceding the claim.

6.4 Indemnification

You agree to indemnify, defend, and hold harmless ViscoelasticsApp and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App, violation of these Terms, or infringement of any rights of a third party.

7. Governing Law & Dispute Resolution

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ViscoelasticsApp operates, without regard to its conflict of law provisions.

7.2 Dispute Resolution

Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association.

7.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

7.4 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and ViscoelasticsApp regarding the use of the App.

8. Apple App Store — License Terms (EULA)

These Terms constitute the End-User License Agreement ("EULA") for the App as distributed through the Apple App Store. This Section incorporates the minimum terms required by Apple Inc. ("Apple") for custom EULAs, together with the corresponding provisions of Apple's Licensed Application End User License Agreement ("Standard EULA"), which this EULA replaces for the App. For the purposes of this Section, "Licensed Application" means ViscoelasticsApp and "Licensor" means ViscoelasticsApp / MongiCore. In the event of any conflict between this Section and the rest of these Terms with respect to Apple's rights and obligations, this Section prevails.

8.1 Acknowledgement

This EULA is concluded between you and the Licensor only — not with Apple. The Licensor, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.

8.2 Scope of License

The license grant and restrictions in Section 5.2 and 5.3 apply to the Licensed Application, subject to the following Apple-specific conditions: the license is limited to Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time, and if you sell your Apple device to a third party you must first remove the Licensed Application from it.

8.3 Maintenance and Support

The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law. You and the Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

8.4 Warranty

The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed (see Section 6). In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Licensor's sole responsibility.

8.5 Product Claims

You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit the Licensor's liability to you beyond what is permitted by applicable law.

8.6 Intellectual Property Rights

You and the Licensor acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

8.7 Legal Compliance & Export Control

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on the U.S. Treasury Department's Specially Designated Nationals List, the U.S. Department of Commerce Denied Persons List or Entity List, or any other U.S. Government list of prohibited or restricted parties. You may not use, export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which it was obtained, and you agree not to use it for any purpose prohibited by United States law, including the development, design, manufacture or production of nuclear, missile, or chemical or biological weapons.

8.8 Developer Name and Address; Contact

The Licensor's name, address and contact details for any questions, complaints or claims with respect to the Licensed Application are set out in Section 7.5 above.

8.9 Third-Party Terms of Agreement

You must comply with any applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).

8.10 Third-Party Beneficiary

You and the Licensor acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

8.11 Consent to Use of Data

In addition to the data described in Section 3, you agree that the Licensor may collect and use technical data about your device, system and application software gathered periodically to facilitate software updates, product support and other services related to the Licensed Application, in a form that does not personally identify you, to improve its products or provide services to you — subject to the data protection principles set out in Section 3.

8.12 Termination

This EULA is effective until terminated by you or the Licensor. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and destroy all copies, full or partial, of the Licensed Application.

8.13 External Services

The Licensed Application may enable access to the Licensor's and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. The Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by the Licensed Application or any External Service — including but not limited to medical information — is for general educational and informational purposes only and is not guaranteed by the Licensor or its agents (see Section 2). You will not use the External Services in any manner that is inconsistent with these Terms or that infringes the intellectual property rights of the Licensor or any third party, and you agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity. External Services may not be available in all languages or in your home country, and may not be appropriate or available for use in any particular location; to the extent you choose to use External Services, you are solely responsible for compliance with any applicable laws. The Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

8.14 U.S. Government End Users

The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to these Terms. Unpublished rights are reserved under the copyright laws of the United States.

1. Términos de Uso

1.1 Aceptación de los Términos

Al acceder, descargar o usar ViscoelasticsApp ("la Aplicación", "el Servicio"), usted acepta estar sujeto a estos Términos y Condiciones ("Términos"). Si no está de acuerdo con estos Términos, no debe acceder ni usar la Aplicación.

1.2 Descripción del Servicio

ViscoelasticsApp es una aplicación móvil que proporciona contenido educativo y de consulta académica relacionado con las pruebas de coagulación viscoelástica, incluyendo ROTEM, TEG y Quantra. La Aplicación ofrece simulación interactiva de curvas, valores de referencia de parámetros, algoritmos clínicos educativos y recursos de aprendizaje basados en literatura médica actual con actualizaciones continuas.

1.3 Elegibilidad

La Aplicación está destinada a profesionales de la salud, estudiantes de medicina, investigadores e individuos con formación médica o científica pertinente. Al usar la Aplicación, usted declara tener la formación profesional adecuada para comprender y contextualizar el contenido educativo proporcionado.

1.4 Registro de Cuenta

Para acceder a ciertas funciones, es posible que deba crear una cuenta. Usted acepta:

• Proporcionar información de registro precisa y completa
• Mantener la seguridad de las credenciales de su cuenta
• Notificarnos inmediatamente cualquier acceso no autorizado a su cuenta
• Aceptar la responsabilidad de toda actividad que ocurra bajo su cuenta

1.5 Modificaciones a los Términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Los cambios entrarán en vigor al publicar los Términos actualizados dentro de la Aplicación o en nuestro sitio web. El uso continuado de la Aplicación tras los cambios constituye la aceptación de los Términos modificados.

2. Aviso Médico

2.1 Únicamente con Fines Educativos

Todo el contenido de ViscoelasticsApp — incluyendo interpretaciones de parámetros, algoritmos clínicos, sugerencias terapéuticas y valores de referencia — se proporciona únicamente con fines educativos e informativos. La información se basa en literatura científica publicada y guías clínicas internacionales, y está destinada a complementar, no reemplazar, la formación médica y el entrenamiento profesional.

2.2 No es un Dispositivo Médico

ViscoelasticsApp NO ha sido certificada, autorizada ni aprobada por ningún organismo regulador, incluyendo:

• La FDA (Food and Drug Administration) de EE. UU.
• La Agencia Europea de Medicamentos (EMA) o autoridades de marcado CE
• INVIMA (Instituto Nacional de Vigilancia de Medicamentos y Alimentos)
• Cualquier otro organismo regulador nacional o internacional de dispositivos médicos

2.3 Juicio Médico Profesional

La Aplicación NO reemplaza:

• El juicio médico profesional y la experiencia clínica
• Los protocolos institucionales y procedimientos operativos estándar
• Las guías clínicas actuales
• La evaluación clínica específica del paciente
• Los procedimientos de confirmación de laboratorio y control de calidad

2.4 Responsabilidad Clínica

Todas y cada una de las decisiones clínicas — incluyendo decisiones de transfusión, administración de medicamentos, intervenciones quirúrgicas o cualquier otra acción de manejo del paciente — son y siguen siendo responsabilidad exclusiva del profesional de salud tratante. Los desarrolladores y operadores de ViscoelasticsApp no asumen ninguna responsabilidad por las decisiones clínicas tomadas ni por los resultados en pacientes derivados del uso de la Aplicación.

2.5 Sin Datos de Pacientes

La Aplicación no está diseñada para almacenar, transmitir ni procesar datos reales de pacientes con fines clínicos. Cualquier dato ingresado en la Aplicación debe tratarse únicamente como datos de simulación educativa.

3. Resumen de Política de Privacidad

3.1 Datos que Recopilamos

Recopilamos únicamente los datos estrictamente necesarios para el funcionamiento de la Aplicación:

• Datos de cuenta: nombre, correo electrónico y contraseña cifrada (o ID de proveedor social: Google/Apple) cuando usted se registra
• Perfil profesional opcional: especialidad médica, institución, país (suministrados voluntariamente)
• Datos técnicos mínimos: identificador anónimo del dispositivo, sistema operativo, idioma y registros de errores para fines de diagnóstico
• Imágenes capturadas: las imágenes ROTEM/TEG/Quantra se envían a Google Vertex AI para análisis en tiempo real — NO se almacenan en nuestros servidores ni en los de Google
• Casos clínicos académicos anónimos: Los usuarios expertos pueden crear y guardar casos, que se almacenan sin identificadores de pacientes, para fines educativos colaborativos

NO recopilamos: datos de identificación de pacientes, historial médico, ubicación GPS, contactos, fotos personales, datos biométricos ni datos de salud personal del usuario.

3.2 Seguridad de los Datos

• Todas las comunicaciones cifradas mediante TLS 1.3
• Contraseñas almacenadas con bcrypt (no recuperables)
• Autenticación Google/Apple mediante OAuth2 / OpenID Connect
• Acceso a la base de datos restringido por roles y auditoría
• Principios de minimización de datos y privacidad por diseño

3.3 Compartición de Datos

NO vendemos, arrendamos ni comercializamos su información personal. Compartimos datos estrictamente operativos solo con: Google Cloud Platform / Vertex AI, Apple Inc. (Sign in with Apple) y Supabase (base de datos y autenticación). Ninguno de estos proveedores usa sus datos para fines distintos a los descritos.

3.4 Sus Derechos

Conforme a GDPR y CCPA puede acceder, corregir, eliminar, exportar o restringir el procesamiento de sus datos en cualquier momento. Puede retirar su consentimiento eliminando su cuenta. Contacto: soporte@viscoelasticsapp.com

4. Términos de Suscripción y Pago

4.1 Nivel Gratuito

ViscoelasticsApp ofrece un nivel gratuito con funciones limitadas. El nivel gratuito puede modificarse, ampliarse o restringirse a nuestra discreción.

4.2 Suscripción Premium

Las funciones Premium están disponibles a través de una suscripción de pago. Al suscribirse, usted acepta:

• Pagar las tarifas de suscripción aplicables tal como se muestran al momento de la compra
• Renovación automática al final de cada período de facturación a menos que se cancele
• Las tarifas se cobran exclusivamente a través de Apple In-App Purchase (iOS)

4.3 Cancelación y Reembolsos

Puede cancelar su suscripción en cualquier momento a través de la configuración de su perfil dentro de la Aplicación o mediante la gestión de suscripciones de su Apple ID en Configuración de iOS. Tras la cancelación, conserva acceso a las funciones Premium hasta el final del período de facturación actual. Las políticas de reembolso se rigen por los términos de la App Store de Apple.

4.4 Licencias Institucionales

Las licencias institucionales (hospital, universidad u organización) están disponibles bajo acuerdos separados. Contacto: soporte@viscoelasticsapp.com

4.5 Cambios de Precio

Nos reservamos el derecho de modificar los precios de suscripción. Los suscriptores existentes serán notificados al menos 30 días antes de que cualquier cambio de precio entre en vigor.

5. Propiedad Intelectual

5.1 Titularidad

Todo el contenido, funciones, diseño, código, gráficos, logotipos y marcas comerciales de ViscoelasticsApp son propiedad exclusiva de ViscoelasticsApp / MongiCore y sus licenciantes. Esto incluye:

• El nombre, logotipo y marca de ViscoelasticsApp
• Código de software y algoritmos
• Contenido educativo y marcos de decisión clínica
• Diseño de interfaz de usuario y elementos visuales
• Documentación y materiales instructivos

5.2 Licencia Limitada

Le otorgamos una licencia limitada, no exclusiva, intransferible y revocable para usar la Aplicación con fines educativos personales y profesionales, sujeta a estos Términos.

5.3 Restricciones

Usted NO puede:

• Copiar, modificar, distribuir, vender o arrendar ninguna parte de la Aplicación
• Realizar ingeniería inversa, descompilar o desensamblar la Aplicación
• Usar el contenido de la Aplicación en cualquier producto o servicio comercial sin permiso escrito previo
• Eliminar o alterar avisos de propiedad o etiquetas
• Usar la Aplicación de cualquier manera que pueda dañar, deshabilitar o deteriorar el Servicio

5.4 Contenido de Terceros

La Aplicación hace referencia a literatura médica actual revisada por pares con fines educativos. Todas estas referencias se atribuyen a sus respectivos autores y organizaciones. ViscoelasticsApp no está afiliada, respaldada ni patrocinada por ninguna organización.

6. Limitación de Responsabilidad

6.1 Exención de Garantías

La Aplicación se proporciona "TAL CUAL" y "SEGÚN DISPONIBILIDAD" sin garantías de ningún tipo, ya sean expresas o implícitas, incluyendo pero no limitado a garantías implícitas de comerciabilidad, idoneidad para un fin particular, precisión, integridad o no infracción.

6.2 Limitación

En la máxima medida permitida por la ley aplicable, ViscoelasticsApp, sus desarrolladores, propietarios, directivos, empleados, agentes y afiliados NO serán responsables de:

• Ningún daño directo, indirecto, incidental, especial, consecuente o punitivo
• Ninguna pérdida de ganancias, datos, fondo de comercio u otras pérdidas intangibles
• Ninguna decisión clínica tomada basándose en información proporcionada por la Aplicación
• Ningún resultado en pacientes, eventos adversos o complicaciones médicas
• Ningún error, omisión o inexactitud en el contenido
• Ningún acceso no autorizado o alteración de sus datos
• Ninguna interrupción o cese del Servicio

6.3 Responsabilidad Máxima

En ningún caso nuestra responsabilidad total hacia usted por todas las reclamaciones excederá el importe que haya pagado a ViscoelasticsApp en los doce (12) meses anteriores a la reclamación.

6.4 Indemnización

Usted acepta indemnizar, defender y mantener indemne a ViscoelasticsApp y sus afiliados de cualquier reclamación, daño, pérdida, responsabilidad y gastos (incluidos honorarios de abogados) que surjan de o estén relacionados con su uso de la Aplicación, violación de estos Términos o infracción de derechos de terceros.

7. Ley Aplicable y Resolución de Disputas

7.1 Ley Aplicable

Estos Términos se regirán e interpretarán de conformidad con las leyes de la jurisdicción en la que opera ViscoelasticsApp, sin tener en cuenta sus disposiciones sobre conflicto de leyes.

7.2 Resolución de Disputas

Cualquier disputa que surja en relación con estos Términos se intentará resolver primero mediante negociación de buena fe. Si no se puede alcanzar una resolución, las disputas se someterán a arbitraje vinculante de conformidad con las reglas de la asociación de arbitraje aplicable.

7.3 Divisibilidad

Si alguna disposición de estos Términos se considera inválida o inaplicable, las disposiciones restantes seguirán siendo válidas y aplicables en la máxima medida permitida por la ley.

7.4 Acuerdo Completo

Estos Términos, junto con nuestra Política de Privacidad y cualquier término adicional para funciones específicas, constituyen el acuerdo completo entre usted y ViscoelasticsApp con respecto al uso de la Aplicación.

8. Apple App Store — Términos de Licencia (EULA)

Estos Términos constituyen el Acuerdo de Licencia de Usuario Final ("EULA") de la Aplicación tal como se distribuye a través del App Store de Apple. Esta Sección incorpora los términos mínimos exigidos por Apple Inc. ("Apple") para EULAs personalizados, junto con las disposiciones correspondientes del Acuerdo de Licencia de Usuario Final de Aplicación Licenciada de Apple ("EULA Estándar"), al cual este EULA reemplaza para la Aplicación. A efectos de esta Sección, "Aplicación Licenciada" significa ViscoelasticsApp y "Licenciante" significa ViscoelasticsApp / MongiCore. En caso de conflicto entre esta Sección y el resto de estos Términos respecto a los derechos y obligaciones de Apple, prevalece esta Sección.

8.1 Reconocimiento

Este EULA se celebra únicamente entre usted y el Licenciante — no con Apple. El Licenciante, y no Apple, es el único responsable de la Aplicación Licenciada y de su contenido. Este EULA no establece reglas de uso de la Aplicación Licenciada que entren en conflicto con los Términos y Condiciones de Apple Media Services, que usted reconoce haber tenido la oportunidad de revisar.

8.2 Alcance de la Licencia

El otorgamiento de licencia y las restricciones de las Secciones 5.2 y 5.3 aplican a la Aplicación Licenciada, sujetas a las siguientes condiciones específicas de Apple: la licencia se limita a productos de marca Apple que usted posea o controle, conforme a las Reglas de Uso establecidas en los Términos y Condiciones de Apple Media Services, con la excepción de que la Aplicación Licenciada puede ser accedida y usada por otras cuentas asociadas a usted mediante Compartir en Familia (Family Sharing) o compras por volumen. Salvo lo previsto en las Reglas de Uso, usted no puede distribuir ni poner la Aplicación Licenciada a disposición a través de una red donde pueda ser usada por múltiples dispositivos al mismo tiempo, y si vende su dispositivo Apple a un tercero, debe primero eliminar la Aplicación Licenciada del mismo.

8.3 Mantenimiento y Soporte

El Licenciante es el único responsable de proporcionar los servicios de mantenimiento y soporte con respecto a la Aplicación Licenciada, según se especifica en estos Términos o según lo exija la ley aplicable. Usted y el Licenciante reconocen que Apple no tiene obligación alguna de proporcionar servicios de mantenimiento o soporte con respecto a la Aplicación Licenciada.

8.4 Garantía

El Licenciante es el único responsable de cualquier garantía del producto, ya sea expresa o implícita por ley, en la medida en que no haya sido efectivamente excluida (véase la Sección 6). En caso de que la Aplicación Licenciada no se ajuste a cualquier garantía aplicable, usted podrá notificarlo a Apple, y Apple le reembolsará el precio de compra de la Aplicación Licenciada. En la máxima medida permitida por la ley aplicable, Apple no tendrá ninguna otra obligación de garantía con respecto a la Aplicación Licenciada, y cualquier otra reclamación, pérdida, responsabilidad, daño, costo o gasto atribuible a la falta de conformidad con cualquier garantía será responsabilidad exclusiva del Licenciante.

8.5 Reclamaciones sobre el Producto

Usted y el Licenciante reconocen que el Licenciante, y no Apple, es responsable de atender cualquier reclamación suya o de terceros relacionada con la Aplicación Licenciada o con su posesión y/o uso de la misma, incluyendo, entre otras: (i) reclamaciones de responsabilidad por producto; (ii) cualquier reclamación de que la Aplicación Licenciada no cumple con algún requisito legal o regulatorio aplicable; y (iii) reclamaciones derivadas de la legislación de protección al consumidor, privacidad o similar. Este EULA no limita la responsabilidad del Licenciante frente a usted más allá de lo permitido por la ley aplicable.

8.6 Derechos de Propiedad Intelectual

Usted y el Licenciante reconocen que, en caso de cualquier reclamación de terceros de que la Aplicación Licenciada o su posesión y uso de la misma infringe derechos de propiedad intelectual de ese tercero, el Licenciante, y no Apple, será el único responsable de la investigación, defensa, resolución y liquidación de dicha reclamación por infracción de propiedad intelectual.

8.7 Cumplimiento Legal y Control de Exportaciones

Usted declara y garantiza que (i) no se encuentra en un país sujeto a un embargo del Gobierno de los EE. UU. ni designado por el Gobierno de los EE. UU. como país que "apoya el terrorismo"; y (ii) no figura en la Lista de Nacionales Especialmente Designados del Departamento del Tesoro de los EE. UU., en la Lista de Personas Denegadas o la Lista de Entidades del Departamento de Comercio de los EE. UU., ni en ninguna otra lista del Gobierno de los EE. UU. de partes prohibidas o restringidas. Usted no puede usar, exportar ni reexportar la Aplicación Licenciada salvo en la forma autorizada por las leyes de los Estados Unidos y las de la jurisdicción en la que se obtuvo, y acepta no usarla para ningún propósito prohibido por la ley de los Estados Unidos, incluyendo el desarrollo, diseño, fabricación o producción de armas nucleares, misiles o armas químicas o biológicas.

8.8 Nombre y Dirección del Desarrollador; Contacto

El nombre, dirección y datos de contacto del Licenciante para cualquier pregunta, queja o reclamación con respecto a la Aplicación Licenciada figuran en la Sección 7.5 anterior.

8.9 Términos de Acuerdos con Terceros

Usted debe cumplir con los términos de acuerdos con terceros que le sean aplicables al usar la Aplicación Licenciada (por ejemplo, su contrato de servicio de datos inalámbricos).

8.10 Tercero Beneficiario

Usted y el Licenciante reconocen y aceptan que Apple, y las subsidiarias de Apple, son terceros beneficiarios de este EULA, y que, una vez que usted acepte los términos y condiciones de este EULA, Apple tendrá el derecho (y se considerará que ha aceptado el derecho) de hacer valer este EULA frente a usted como tercero beneficiario del mismo.

8.11 Consentimiento para el Uso de Datos

Además de los datos descritos en la Sección 3, usted acepta que el Licenciante pueda recopilar y usar datos técnicos sobre su dispositivo, sistema y software de aplicación, recopilados periódicamente para facilitar actualizaciones de software, soporte del producto y otros servicios relacionados con la Aplicación Licenciada, en una forma que no lo identifique personalmente, para mejorar sus productos o proporcionarle servicios — sujeto a los principios de protección de datos establecidos en la Sección 3.

8.12 Terminación

Este EULA es efectivo hasta que sea terminado por usted o por el Licenciante. Sus derechos bajo este EULA terminarán automáticamente si usted incumple cualquiera de sus términos. Al terminar, usted debe cesar todo uso de la Aplicación Licenciada y destruir todas las copias, totales o parciales, de la Aplicación Licenciada.

8.13 Servicios Externos

La Aplicación Licenciada puede habilitar el acceso a servicios y sitios web del Licenciante y/o de terceros (colectiva e individualmente, "Servicios Externos"). Usted acepta usar los Servicios Externos bajo su exclusivo riesgo. El Licenciante no es responsable de examinar ni evaluar el contenido o la exactitud de los Servicios Externos de terceros, y no será responsable por dichos Servicios Externos de terceros. Los datos mostrados por la Aplicación Licenciada o cualquier Servicio Externo — incluyendo, entre otros, información médica — son únicamente para fines educativos e informativos generales y no están garantizados por el Licenciante ni sus agentes (véase la Sección 2). Usted no usará los Servicios Externos de manera incompatible con estos Términos ni de forma que infrinja derechos de propiedad intelectual del Licenciante o de terceros, y acepta no usar los Servicios Externos para acosar, abusar, hostigar, amenazar o difamar a ninguna persona o entidad. Los Servicios Externos pueden no estar disponibles en todos los idiomas o en su país de residencia, y pueden no ser apropiados o estar disponibles para su uso en cualquier ubicación particular; en la medida en que decida usar Servicios Externos, usted es el único responsable del cumplimiento de las leyes aplicables. El Licenciante se reserva el derecho de cambiar, suspender, eliminar, deshabilitar o imponer restricciones o límites de acceso a cualquier Servicio Externo en cualquier momento, sin previo aviso ni responsabilidad hacia usted.

8.14 Usuarios Finales del Gobierno de los EE. UU.

La Aplicación Licenciada y la documentación relacionada son "Artículos Comerciales" ("Commercial Items"), según se define dicho término en 48 C.F.R. §2.101, compuestos por "Software Informático Comercial" y "Documentación de Software Informático Comercial", según se usan dichos términos en 48 C.F.R. §12.212 o 48 C.F.R. §227.7202, según corresponda. De conformidad con 48 C.F.R. §12.212 o 48 C.F.R. §227.7202-1 a 227.7202-4, según corresponda, el Software Informático Comercial y la Documentación de Software Informático Comercial se licencian a los usuarios finales del Gobierno de los EE. UU. (a) solo como Artículos Comerciales y (b) únicamente con los derechos otorgados a todos los demás usuarios finales conforme a estos Términos. Los derechos no publicados quedan reservados bajo las leyes de derechos de autor de los Estados Unidos.
